PI Brief Update

If you are a subscriber to this online resource for personal injury information and updates then you can see my latest article examining whether or not the courts can force parties to mediate. Personally I don’t think they should, it is likely to lead to the wrong cases being mediated and probably unnecessary expense incurred. Personal Injury lawyers don’t want mediation rammed down their throats. What I think the court should be doing is meeting it’s obligations under CPR 1.4(e) and actively encouraging mediation in appropriate cases.
