You may have seen the stories in the last week reporting £82 million having been paid out by 90 local authorities who responded to a Freedom of Information request by the Liberal Democrats. Amongst those reporting it were the BBC and so the Local Government Chronicle. I have had a look at the research and the most striking element is not the usual “compensation culture” headlines – what it shows is a dramatic fall year-on-year for the past 5 years. From 2004 the figures have been £28 million, £20m, £15m, £11m down to £6.7m.
I am not sure what the explanation for this is. What do you think?







Perhaps the increasing use of CFA’s with ATE insurance means that claimant solicitors are less willing to take the risk of going to trial on a highway trip and slip (which are often 50/50 at best) when the financial risk is entirely their own?
