Mediation Services - Telephone Mediation

Telephone mediation has the same objective as a face-to-face mediation settlement meeting – to help the parties find a solution they can all live with. The difference of course is that all the conversations are carried on over the phone – supported by email and fax if necessary.

Arranging the mediation

As the Mediator I arrange with the parties a date and time when everyone will be available. I often use WhenIsGood which is an excellent tool for organising dates. I typically ask the parties to set aside two hours and to be available to take my calls at any time during that period. There is of course nothing to stop lawyers continuing with other work whilst they are not on the phone to me.

Who calls who?

I will make the calls. In that way the procedure moves ahead at the right pace. If the parties are represented I call the representatives unless it is agreed it is appropriate for me to call the party directly. It is up to the parties whether or not they are in the same location as their lawyer or stay in contact with them by phone from their home or workplace.

Is the settlement binding?

If agreement is reached it is written up – usually by the lawyers. It will be signed by each party or their representative and faxed or emailed to each side. Once that has been done there is a binding enforceable agreement.
